These Terms are an agreement between you and Howie's Liquor ("Howie's," "we," "us"), a licensed Texas alcoholic beverage retailer at 11553 E Ricks Circle, Dallas, TX 75230. They govern your use of this website and any order you place through it.
By using this website or placing an order, you accept these Terms. If you do not accept them, please do not use the site.
1. You must be 21 or older
You may use this website and order from us only if you are at least 21 years of age. When you place an order, you confirm that:
you are 21 or older, and so is anyone who will receive the order for you;
you are not buying alcohol for anyone under 21, for anyone who is intoxicated, or for anyone who is not allowed to buy alcohol;
you are not buying for resale; and
the payment method is yours, or you are allowed to use it.
Giving false information about your age breaks these Terms and may be a crime under Texas law. We check ID at pickup and at delivery, every time, with no exceptions.
2. Where the sale takes place
All sales are made at our licensed store in Dallas, Texas. When you place an order you are asking us to sell to you at the store and, if you choose delivery, to bring the order to you at your direction. We do not sell alcohol into any state or area where that sale would be unlawful.
3. Orders, acceptance, and refusal
Your order is an offer to buy. It is not accepted until we send you a confirmation that your order is being filled — an authorization on your card is not by itself acceptance. We may limit quantities, and we may refuse or cancel any order, including before or at the moment we hand it over, if:
we cannot confirm that you are 21 or older;
the person receiving the order has no valid ID, appears to be under 21, or appears intoxicated;
the delivery address is outside our delivery area, or somewhere we may not lawfully deliver;
the item is out of stock or was listed at the wrong price;
we have reason to think the order is for resale or for someone under 21; or
filling the order would break the law or the terms of our permits.
If we cancel an order we have already accepted, we refund you in full.
4. Prices, product information, and mistakes
Prices are in U.S. dollars and do not include sales tax or delivery fees, which are shown at checkout. Prices, promotions, and availability can change without notice, and our in-store and online prices may differ. We try to describe every product accurately, but vintages, labels, alcohol content, and packaging change without notice, so the bottle you receive may not match its photograph. We may correct pricing and description mistakes and cancel an order placed at the wrong price even after it is confirmed. If we do, we will contact you and refund you in full.
5. Substitutions
If something is unavailable when we pack your order, we will contact you before substituting anything. We will never substitute a different type of alcohol, or charge you more than you approved.
6. Payment and taxes
We accept major credit and debit cards. Your card may be authorized when you place the order and charged when we fill it. Texas sales tax and any alcoholic beverage taxes are added at checkout. Tips for delivery drivers are voluntary and go to the driver.
7. Pickup, delivery, and shipping
How we get your order to you is covered by our Delivery Policy and Shipping Policy, both of which are part of these Terms. Delivery times are estimates, not guarantees. Alcohol may be sold, picked up, and delivered only during the hours Texas law allows.
8. Rewards program and house accounts
Rewards points have no cash value, cannot be sold or transferred, and may be forfeited if your account is closed or is used improperly. We may change or end the rewards program at any time and will give notice of significant changes. House accounts are offered at our discretion, and balances are due when we bill them.
9. Returns and refunds
Because we are an alcoholic beverage retailer, alcohol cannot be returned or exchanged once it leaves our store, except where Texas law allows it — generally when a product is defective, spoiled, corked, damaged in transit, or is not what you ordered.
To make a claim, email howiesliquor@gmail.com within 7 days of pickup or delivery with your order number, a photograph, and the product still in your possession. We may ask you to bring it to the store. If we approve the claim, we will replace the product or refund it to your original payment method. Non-alcohol merchandise can be returned unused within 30 days with a receipt. Gift cards and special orders are not refundable. Delivery and shipping problems are covered in those policies.
10. Gift cards
Gift cards do not expire, are not redeemable for cash except where the law requires it, and cannot be replaced if lost or stolen. Gift cards may not be used to buy alcohol by anyone under 21.
11. Your account
Keep your password private. You are responsible for what happens under your account. Email howiesliquor@gmail.com promptly if you think your account has been used without your permission. We may suspend or close an account that breaks these Terms.
12. How you may not use this site
You agree not to: use the site if you are under 21; buy for resale or for a minor; scrape, crawl, or harvest data from the site; interfere with the site or test its security; use bots to buy limited releases; post unlawful, infringing, or abusive content; impersonate anyone; or use the site for any unlawful purpose.
13. Our content
This website, its text, layout, images, and the Howie's Liquor name and logo belong to us and may not be copied or used without our permission. Product names, labels, and brand marks belong to their owners. If you post a review or photograph, you give us permission to use and display it in connection with our business, and you confirm it is yours to share.
14. Other companies and websites
We rely on other companies — payment processors, delivery drivers, and shipping carriers — and we link to brand and information websites. We are not responsible for their content, products, or conduct.
15. Please drink responsibly
Nothing on this site is medical advice. Alcohol carries health risks, including risks during pregnancy, and impairs your ability to drive. You are responsible for how you and your guests use what you buy from us. Never drive impaired.
16. Disclaimers
This website is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not promise that the site will be uninterrupted, secure, or free of errors, or that product descriptions are complete or current. Nothing here excludes any warranty that cannot be excluded under Texas law.
17. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, arising out of your use of this website or any order. Our total liability for any claim will not exceed the amount you paid for the order the claim is about. Some of these limits may not apply where the law does not allow them.
18. Your responsibility to us
You agree to cover our losses and reasonable legal costs if they arise from your breach of these Terms, from misrepresenting your age, or from your giving alcohol to someone under 21 or to someone who is intoxicated.
19. Texas law applies
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and we agree that any dispute will be heard in the state or federal courts located in Dallas County, Texas.
20. Accessibility
We want this website to work for everyone. If you have difficulty using any part of it, email howiesliquor@gmail.com and we will help you place your order and work on fixing the problem.
21. General
We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, supply problems, carrier failures, or government action. If any part of these Terms cannot be enforced, the rest still applies. We may transfer these Terms if our business is sold; you may not transfer them. If we do not enforce a provision right away, we have not given it up. These Terms, together with the policies they link to, are the whole agreement between us about this website.
22. Changes
We may update these Terms. The date at the top will change, and the new version applies to orders placed after it is posted.
